Our client

A managing director of an engineering company

The context

In the event of a limited invitation to tender, an official of a Local Council was accused of favouritism. Our client was suspected of abetting the official.

The course of action

We advised our client throughout the investigations phase and particularly with regard to legal investigations, which enabled us to determine that the transaction could have benefited from the exceptions granted to mutual agreements in the Public Procurement Code, and hence not have to call for tenders.

Throughout the investigations which lasted 5 years, we assisted our client with preparation for questioning by the examining judge and for Court report.
We analysed the risks that enabled to modify certain procedures regarding tender bids within the company.

Our client

A director of an industrial company, charged with manslaughter following the death of one the group’s employees.

The context

In one of the sites, security measures had not been strictly applied, which according to the public prosecutor and labour administrative body, had led to the employee’s death.

The course of action

We assisted and advised the client throughout the initial stages involving the certification of the elements of the infraction. We prepared for possible police custody. We continued to assist throughout the examination and questioning, especially during confrontations between him and other defendants.

The result

The case was referred to the magistrates’ court, where we managed to obtain the qualification of abettor instead of principal defendant, hence avoiding multiple accusations from the plaintiff.
